Labor Compliance Program

The department's Labor Compliance Program is responsible for the following:

  • Interpreting and enforcing labor compliance standards of the contract.
  • Conducting investigations and audits of contractor's payroll records whenever violations are noted or complaints are received from contractor employees.
  • Interviewing employees and DOTD project personnel to determine if employees are under paid or misclassified.
  • Represents the department whenever Labor Compliance reviews are conducted by FHWA, Legislative Auditors or our Internal Audit Section. Provides pertinent information to the U.S. Department of Labor, Wage and Hour Division, to assist them in conducting statewide highway wage surveys in Louisiana.
  • Respond to questions that arise on Davis-Bacon projects regarding proper classifications, payrolls, material suppliers, subcontractors, owner-operators, fringe benefit plans, etc.

Labor Compliance Documents/Posters for Project Sites

If you are required to post the notice to employees working on federal or federally financed construction projects, it must be avaliable on the site of work in a "prominent and accessible place."

Employee Rights

Effective June 21, 2010, federal contractors and subcontractors must notify employees of their rights under the National Labor Relations Act with this poster. It must be displayed conspicously in and around plants and/or offices, and where other employee notices are typically posted.

Family and Medical Leave Act (FMLA)

Outlining employee rights under the Family and Medical Leave Act (FMLA) for those employers that qualify, this must be posted prominently where employees and applicants can clearly see it. If your workforce's primary language is not English, the DOL also requires you to post it in a secondary language. According to the DOL, deliberate refusal or failure to post will result in a $100 fine for each offense.
